Navigate Your Immigration Questions

How long can I stay in Canada as a temporary resident?

The length of stay depends on your specific temporary status:

  • Visitor visas typically allo stays of up to 6 months but sometimes can be extended
  • Study permits are usually for the duration of your study program plus 90 days
  • Work permits vary based on the specific program, typically 1-3 years

Extensions are possible in many cases if you apply before your current status expires

Can I work while on a visitor visa in Canada?

Generally, visitors are not authorized to work in Canada. However, there are some exceptions:

  • Business visitors may engage in certain international business activities without a work permit.
  • If you are already in Canada as visitor, you may be able to apply for a work permit without leaving if you meet specific criteria
  • Some individuals may qualify for a work permit under the international Mobility Program

It's imporatant to consult with an immigration lawyer before undertaking any work activities to ensure compliance with Canadian law

What happens if my temporary resident status expires?

If your temporary resident status expires, you may fall out of status in Canada. Here's what you should know:

  • You have 90 days after expiry to apply for restoration of status (if eligible)
  • After this period, you may need to leave Canada and apply for a new visa/permit
  • Working or studying without valid authorization can lead to removal proceedings
  • Future application may be affected by periods of non-compliance

If you realize your status has expired, contact an immigration lawyer immediately to discuss your options.

Can I extend my study permit or change institutions?

Yes, both extensions and institution changes are are possible under certain conditions:

  • Study permit extensions should be applied for at lease 30 days before expiry
  • You can change Designated Learning Institution (DLI) without applyiong for a new study permit if both institution are DLIs
  • You must notify IRCC through your online account when changing schools
  • If changing study level 9eg. from high school to university), ensure your permit allows post-secondary study

Our team can guide you through these processes to maintain your legal status in Canada

What are my options if my temporary resident application is refused?

A refusal doesn't necessarily mean the end of your Canadian immigration journey. Options may include:

  • Requesting reconsideration if there was a clear error in the decision
  • Applying for judicial review at the Federal Court for certain types of decisions
  • Addressing the refusal reasons and submitting a new, stronger application
  • Exploring alternative immigration pathways that might better suit your situation
  • Applying for a Temporary Resident Permit if inadmissibility is the issue

Our lawyers can analyze your refusal letter and recommend the best course of action based on your specific circumstances.
