Who Qualifies for Refugee Protection in Canada
Convention Refugee
A Convention Refugee is a person who is outside their home country and is unable or unwilling to return because they have a well-founded fear of persecution. This fear must be connected to at least one of the following protected grounds:
Race – including ethnic background, skin colour, or other racial identity.
Religion – including religious beliefs, practices, or lack of religious affiliation.
Nationality – including citizenship, ethnic or linguistic groups, or minority national groups.
Political Opinion – including actual or perceived political views, activities, or affiliations.
Membership in a Particular Social Group – including groups defined by gender, sexual orientation, family ties, or other defining characteristics.
To qualify, the persecution must involve serious harm such as threats to life, freedom, or safety.
Person in Need of Protection
These are individuals already in Canada who cannot return to their home country because they would face a real risk of serious harm, including:
Torture – intentional infliction of severe physical or psychological pain by a government or with its consent.
Risk to Life – threats or dangers that could result in death, including targeted violence, armed conflict, or severe human-rights violations.
Risk of Cruel and Unusual Treatment or Punishment – severe mistreatment that does not meet the definition of torture but still causes serious suffering, such as inhumane prison conditions, violence, or degrading treatment.
